Biography
A. David “David” Fawal is an attorney in Butler Snow LLP’s Birmingham, Alabama office. His principal practice areas include insurance coverage and insurance defense, commercial and business litigation, personal-injury defense, class-action and mass-tort defense, general civil litigation, and military and national-security law.
He has more than 35 years of legal experience and has served as lead or co-counsel in jury trials in Alabama state courts, federal courts, and military venues. He has handled matters in 60 of Alabama’s 67 counties.
Fawal is a retired Commander in the U.S. Navy Reserve Judge Advocate General’s (JAG) Corps. He focuses on defending insurers and commercial entities in high-exposure litigation.

* **Hurricanes Katrina, Sandy and Sally Claims Defense**: Defended hundreds of cases for flood losses brought under flood insurance policies issued by Write Your Own (WYO) insurers under the National Flood Insurance Program.
* **Extracontractual Claims Defense**: Represented numerous insurers and agents in defense of bad faith, fraud, and sales practice claims.
* **Arson & Fraud Summary Judgment**: Obtained summary judgment for an insurer client in breach of contract and bad faith litigation involving arson and fraud, fully affirmed by the Eleventh Circuit Court of Appeals following oral argument.
* **Jury Trials & Appellate Advocacy**: Handled numerous jury trials as lead counsel and co-counsel in state, federal, and military courts, and argued before the Alabama Supreme Court and the Eleventh Circuit.
* **Ephedra Herbal Supplement Litigation**: Co-lead counsel in one of the first trials against a leading ephedra manufacturer (almost three-week trial resulting in a $4.1 million verdict). The case established the ephedra MDL and global settlements.
* **Managed Care MDL Class Representation**: Spent five years representing all 700,000 physicians in the US and state medical associations against deceptive trade practices of eight major health insurers, resulting in civil RICO settlements exceeding $2 billion.
* **Independent Pharmacist Anti-trust Actions**: Represented independent pharmacists in antitrust lawsuits against the nation's four largest pharmacy benefit managers (PBMs), establishing national classes including nearly 25,000 independent pharmacies.
* **Vanishing Premium Class Actions**: Defended major insurance carriers in high-exposure vanishing premium class actions.
