Biography

Francis practices primarily in the areas of corporate and commercial litigation. His practice includes representation in high-stakes disputes for a wide range of clients in many industries as well as for utility companies, governmental entities, and non-profits in multiple states. He also has enjoyed success in litigating, in both federal and state appellate courts, groundbreaking Second Amendment cases and related constitutional issues on behalf of civil rights organizations. In 2015 and 2019, he was honored with The Chief Justice William Killen Award for Distinguished Second Amendment Appellate Advocacy. He has been hired to provide testimony as an expert witness in court on Delaware corporate law and Delaware LLC law. One of his law review articles on corporate law has been cited by both the Delaware Supreme Court and the Delaware Court of Chancery. He has published over 1,000 articles in multiple publications on topics including corporate and commercial law as well as legal ethics and constitutional law. His Annual Review of Key Delaware Corporate and Commercial Decisions, now in its 21st year, has been described by a leading corporate law professor, who is often cited in Delaware court decisions, as “… the single most indispensable event of the corporate law year. A must-read.” He became the Managing Partner of the new Delaware office of Lewis Brisbois on May 1, 2020. Martindale-Hubbell has given him its highest rating of “AV” based on peer review of ability and ethical standards. He has been described as “a brand name in Delaware corporate litigation” and has also been referred to as the “dean of Delaware law bloggers”.
