Biography

Rachael Flanagan, a trial attorney with Cohen Milstein, represents individuals, families, and communities seeking to hold corporations and other powerful entities accountable for conduct that has caused widespread harm. She plays a leading role in developing and litigating complex cases nationwide, helping guide matters from investigation through trial. This includes developing litigation strategy, managing complex discovery and ESI, coordinating expert witness development, and preparing technically sophisticated, fact-intensive cases for trial. Rachael believes the civil justice system provides people with a path to accountability when powerful interests cause them harm. She is drawn to cases that expose corporate wrongdoing and deliver a measure of justice to drive meaningful change for those affected. She thrives in the collaborative, fast-paced environment of complex litigation, where multidisciplinary teams work together to solve challenging legal and factual issues on behalf of their clients. Whether representing a single family or a nationwide class, Rachael is committed to telling her clients’ stories with clarity, credibility, and conviction. In addition to her litigation practice, Rachael is a recognized advocate for mental health awareness and wellness within the legal profession. She served two terms on The Florida Bar’s Mental Health & Wellness Committee, where she helped advance initiatives that support attorney well-being and reduce the stigma surrounding mental illness. Rachael frequently speaks on lawyer wellness, resilience, and burnout prevention, to legal organizations across the country. Rachael also serves as Board president of NAMI Palm Beach County, a leading nonprofit organization dedicated to improving the lives of individuals and families affected by mental illness through education, advocacy, and support. Bains, et al. v. American Tactical, Inc., et al. (D.S.C.): On April 13, 2023, Cohen Milstein and Brady Center to Prevent Gun Violence filed a negligence, public nuisance and unlawful marketing lawsuit against American Tactical, Inc. and others involved in the manufacturing, marketing, and sale of the 60-round high-capacity magazine (HCM) used by the perpetrator in a deadly mass shooting on April 15, 2021 at a FedEx Ground Package facility in Indianapolis, Indiana. Tragically, thirteen people were shot during the attack. Eight died. At least five other people were injured.
